It’s a Bird No it a Plane….No it is a Tax says Chief Justice Roberts about the New Federal Health Care

On June 28, 2012ththe citizens of the United States went into stage 8 or 9 of socialism. The loss of personal freedoms has been like the proverbial frog slowly cooking.  It has been slowly coming over the years during each administration. However , when  Judge Roberts  declared Obamacare a tax  rather than being unconstitutional it was just another proverbial nail in the coffin of American Liberty.

And please it doesn’t matter what party you align yourself with, this is not a party issue. This Road to socialism began years ago under each party’s administration. Prior to the Obama administration, Republicans controlled the White House for 20 out of 28 years. If Republicans were going to fundamentally change the nature of the Supreme Court,  that was their opportunity.

But it didn’t happen.

Instead, what we have is a Supreme Court that is dominated by judges that have very little respect for the U.S. Constitution

Americans now have lost another freedom in making choices for their own lives. If we are told we must buy  health care where will these coercive laws stop? . We probably be told that we can have so much salt in our diet and the excess will result in higher insurance premium or perhaps that we have to buy a certain biodegradable toilet paper. Or maybe they will tell us how many children we can have…I mean we don’t want to cause too much of a carbon foot print. Now do we?

Don’t get me wrong I do believe that Americans need to adopt healthier lifestyles and that the majority of our diseases such as diabetes, obesity and heart disease is preventable. That is not my point. Nor am I saying that the medical system doesn’t need an overhaul. However, I don’t believe that we should give up our right of choice.

The point is that we are being coerced into complying into a system that we have no choice in. In fact if you don’t comply the IRS will be part of that compliance. Here is a picture I found that shows you the flow chart

Let’s see if you don’t want to buy a policy in the new federal health care you can claim religious exemption if your religion exempts you from that…I guess we will have to join whatever one that is, or make less less than 9,350, belong to an Indian tribe etc. etc.

Freedom of choice is not a footnote to legal history. It is a fundamental to a democratic society.

John Stuart Mill (1806-1873) knew that individual freedom was likely to be a vital question of the future. Mills opposed the tyranny of prevailing opinion and feeling and the repression of minority opinions and behavior.

He believed that every person must have freedom of action as long as it did not infringe on another’s well- being.

And not only are we going to be affected by Obama Care but so will the medical establishment. Ironically sometimes we hear doctors say that thy believe in medical freedom of choice, but only as long as it is “informed choice.” Of course it is they that want to do the informing”

So in that case, they are denying the fundamental right to be “foolish” But if your right to be foolish so to speak is not respected than Mills would say that your society is not free, “whatever the form of government maybe.

Medical doctors now are certainly not the winners in the passing of Obamacare. Perhaps  medical Insurances and medical  equipment companies may come out as a winner but Doctors will be forced to take more patients in an already over-crowded system with more and more paper-work. Right now many doctors are not taking any more Medicare patients.

So the government is no longer respecting your right make personal health care choices for yourself or your family. It is now mandated and enforced with a stick being the IRS. In fact, the Obama administration has given the IRS 500 million extra dollars “outside the normal appropriations process” to help them enforce the provisions of Obamacare that they are in charge of overseeing.

Mills went on to say, “the only freedom is that of pursing our own good in our own way..Each is the proper guardian of his own health, whether bodily, or mental and spiritual. “

As a Christian I realize that I must answer to a God one day…and whether you believe or don’t believe it is still your right to hold that belief and not coerce you into my way of thinking.

However, the right of patient autonomy is grounded in a more general “right to  privacy”, a common-law  that was first clearly articulated in a landmark 1890 Harvard Law Review (4:193-220) article by Louis Brandies and Samuel Warren.

And in 1914 New York Judge Benjamin Cardozo (the future Supreme court Justi ce_ used  this concept when he made a decision in Schloendorff v. Society of New York Hospital when he said:

“Every human being of adult years and sound mind has a right to determine what shall be done with his own body.”

A famous quote from a dissent in Olmstead v. US (277 U.S. 438(1928 ) Brandies said:

The makers of our constitution realized the significance of man’s spiritual nature his feeling, his intellect. They understood that man’s pain, pleasure and satisfactions of life are not just found in material things. So the founding father’s sought to protect American in their beliefs, their thoughts , and their emotions and their sensations. They conferred, as against  the government , the right to be left alone-the most comprehensive of rights and the right most valued by civilized men”

Perhaps Chief Justice Roberts really means what he wrote — that congressional power to tax is without constitutional limit. I think what he really meant is that the Supreme court will decide whatever the want without any regards to the constitution.

We will either need to stand up and get involved and protect our constitution or learn to sing the old Beetles song,  The Taxman. Obamacare’s centerpiece is a half trillion dollar tax hike on the middle class. So you thought the government was paying for your healthcare? Seriously?
